Thank you for using our products and services (collectively, “Services”). The Services are provided by Postmaster LLC ("Postmaster") organized under the laws of the State of Washington, with primary place of business at 522 W Riverside Ave Suite N, Spokane, WA 99201, United States.
These Terms of Service (“Terms”) help define the relationship between you and Postmaster. Broadly speaking, we give you permission to use our services if you agree to follow these terms, which reflect how Postmaster's business works. When we speak of “Postmaster,” “we,” “us,” and “our,” we mean Postmaster LLC and its affiliates.
These Terms apply to all Postmaster operated websites, mobile, and desktop applications, and this includes those that are already in operation and those that will later be developed. These Terms constitute a legally binding agreement between you and us as it pertains to your access to and use of our Services. By using our Services, you are agreeing to these Terms. Our Services and Relationship with you
Postmaster gives you the platform to find, compare, and buy courier services for shipping packages. When you purchase postage on Postmaster, you are purchasing the postage from the third-party mail service or courier (“Courier”) which you have selected. You are not purchasing the postage from Postmaster. Therefore, the shipping contract is between you and the Courier you have selected, not between you and Postmaster. The relationship between you and the Courier is governed by the terms and conditions of the particular Courier you have selected, which you will usually find on their website.
When you buy postage from the Courier via Postmaster, Postmaster will provide you with a shipping label, which serves as evidence of your purchase, and with which you can deposit your parcel at the collection point.
To be clear, Postmaster is not a courier service provider or a shipper, it does not transport or deliver shipments, and Postmaster is not a party to any contract you form with a Courier to pick up, transport, or deliver your shipments.
Intellectual Property and Content Licensing
Our Services include content such as downloadable software, source code, cartoons, images, audio and video clips, and other materials (collectively, “Content”). These Content are our proprietary assets and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Content except where expressly encouraged, or licensed in advance. You may not reverse engineer, decompile, or attempt to extract the source code of our software under any circumstance.
Use of Our Services
You may use our Services only as permitted by applicable laws and regulation; You may not access our Services using any method other than the interface and instructions we provide.
Using Postmaster Services requires you to create an account. When you do this, all registration information you provide to us must be true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, we reserve the right to suspend or terminate your account and refuse any and all current or future use of our Services.
By registering for an account, you agree to keep your password confidential. You are responsible for all activities on your account. If you learn of any unauthorized access to your account, reset your password immediately.
Duty to Provide Accurate Weight and Measurement
For the purpose of calculating the cost of your postage, Postmaster requires you to provide the measurements, weight and other description of your parcel. It is your duty to provide accurate information for this purpose. If you misrepresent the measurement or weight of your parcel, either intentionally or unintentionally, and thereby receive a lower cost estimate for your parcel, and purchase a postage based on this, Postmaster reserves the right to charge the correct cost of postage, based on the correct measurement of your parcel at the collection point, to your means of payment.
Indemnification
You agree to defend, indemnify and hold harmless Postmaster, its contractors, licensors, and partners; and the respective directors, officers, employees and agents of the foregoing ("Indemnified Parties") from and against any and all third party claims and expenses, including attorneys' fees, arising out of or related to your use of our Services.
Limitation of Liabilities
To the extent permitted by law, the total liability of Indemnified Parties for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services. In all cases, Postmaster and its affiliates will not be liable for any loss or damage that is not reasonably foreseeable. Particularly, Postmaster will not be liable for any loss or damage to your parcels.
Your Privacy
Our Privacy Policy explains how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Postmaster can use such data in accordance with our privacy policy.
By utilizing our service, you hereby provide your consent to receive telephone and electronic mail notifications pertaining to your transaction and other associated services.
Modification to these Terms
We may update these Terms from time to time to address a new feature of our Services or to clarify a provision. The updated Terms will be posted online. If the changes are substantive, we will announce the update through our usual channels for such announcements such as blog posts, banners, or emails. Your continued use of our Services after the effective date of such changes constitutes your acceptance of such changes.
